The Purpose:

While an Ordinary Summons is the default process for contentious matters where facts will be heavily disputed, a Summary Summons is designed for straightforward, non-contentious financial claims.

The Statutory Provision:

Under Order 3 Rule 1 of the MCR, a claimant can utilize this fast-track procedure if their action is for the recovery of a debt or liquidated money demand (a specific, mathematically ascertainable sum of money), with or without a claim for interest.

The Application Procedure:

You do not just file your forms and automatically get a Summary Summons. The rule expressly mandates that the claimant must file a claim and request by letter to the Registrar that the claim be endorsed as a Summary Summons.


Segment 2: The Strict Exceptions (The "IMAMS" Trap)

This is the most highly tested aspect of Order 3 Rule 1 in your Bar Finals. The rule contains a strict proviso listing specific scenarios and persons against whom a Summary Summons cannot be issued, even if the claim is for a liquidated money demand.

    AssigneeOn behalf of an assignee of a debt or other thing in action.

    Mortgage/ChargeTo recover money secured by a mortgage or charge.
  • S
    Service outside jurisdictionAgainst a defendant who has to be served outside the jurisdiction of the court.
